Our acceptable use policy and guidelines

1. General

This Acceptable Use Policy ("AUP") describes activities that are prohibited in connection with your use of the Products (as defined below) and outlines the standards of conduct we require on the Services and is designed to protect the integrity of the Services and other users. This Acceptable Use Policy applies to your use of any tools, platform or features that Filmia makes available and all Users must comply with Filmia's AUP.

This AUP may be updated from time to time. By continuing to use the Products or access your account after a revised version of the AUP has been posted, you agree to comply with the latest version of the AUP. This policy may change as Filmia grows and evolves, so please check back regularly for updates and changes.

We may provide translations of this AUP into various languages merely for informative purposes. However, the English version is the only legally binding version. In the event of any discrepancy between the English version and a translated version, the English version shall prevail. Some features or tools may include additional usage restrictions. In such a case, this Acceptable Use Policy shall apply in conjunction with such additional usage restrictions.

2. Conduct Restrictions

While using the Services, you may not:

  1. damage, disable, override, interfere with, or circumvent any aspect of the Services (including any safety, integrity, or privacy filters, instructions, controls, safeguards, or other mechanisms offered by, as part of, or with the Services);
  2. interfere with the Services operation (e.g., by exceeding or trying to exceed load specifications or by using the Services to generate synthetic data) or anyone else's use of the Services;
  3. test, penetrate, or scan the Services for security vulnerabilities or limitations;
  4. impersonate anyone or misrepresent your connection with any person or entity;
  5. use the Services to compete with Filmia, or copy any ideas, features, functions, or graphics of the Services;
  6. distribute any unwanted communication (e.g., using the Services to send spam);
  7. use the Services for activities where use or failure of the Services could lead to death, bodily injury, damage to personal property, or environmental damage;
  8. access or use the Services in a manner intended to avoid incurring fees owed (e.g. by repeatedly transferring a seat to and from the same user(s) to avoid paying for the appropriate number of seats needed, or by sharing account credentials -- each user account is personal to the user to which it is issued);
  9. act in bad faith;
  10. scrape, data mine, access Filmia or Filmia content (including third party content made available through Filmia) programmatically;
  11. use a third party's content without their permission (e.g., use stolen content);
  12. deceive or mislead any person, including by indication, that any AI output was solely human generated or modify, tamper with, remove, obscure, or otherwise alter any metadata, digital signatures, or watermarks that identify AI output as generated using a generative artificial intelligence model;
  13. use the Services in a way that causes, or is intended to cause, bias, harm, or discrimination against an individual or to make solely automated decisions about individuals which could have a legal or similarly significant effect;
  14. modify, or use anything that modifies, Filmia's code or code execution; or
  15. use the Services in a manner that is intended to avoid applicable international sanctions with respect to an individual or organization.

3. Content Restrictions

You may not upload or publish to the Services, or use the Services to distribute, create, collect, or publish anything that:

  1. is fraudulent, false, misleading, or deceptive;
  2. is defamatory, obscene, pornographic, vulgar, or offensive;
  3. seeks to harm, abuse or exploit minors;
  4. promotes, or is intended to promote, discrimination, bigotry, racism, hatred, harassment, bullying, or harm against any individual or group;
  5. promotes or creates a risk of physical or mental harm, emotional distress, death, disability, or disfigurement to yourself, any person, or animal;
  6. is violent or threatening or promotes violence or actions that are threatening to any person or entity;
  7. promotes illegal or harmful activities, goods, or substances, including but not limited to counterfeits, drug use, terrorism or human trafficking;
  8. promotes or creates a risk of harm, loss, or damage to any property;
  9. is malicious or destructive, such as software viruses, worms, trojan horses, spyware, dishonest adware, scareware, crimeware, or any other malicious or destructive software of programs;
  10. is illegal or solicits conduct that is illegal under laws applicable;
  11. involves the sale or promotion of illegal activities, products, or services;
  12. violates the rights of others, including data privacy, confidentiality, and/or intellectual property rights (e.g., upload or publish stolen content);
  13. contains any information or content (including personal data) that you do not have a right to make available under any law or due to confidentiality, contractual, or fiduciary duties;
  14. is or includes sensitive information subject to regulation or protection under applicable laws, including but not limited to Special Category Data as defined under the General Data Protection Regulation (GDPR) (for example, data relating to race, religion, politics, health, genetics, biometrics, or sexual orientation);
  15. threatens or undermines democratic processes or institutions;
  16. is or includes patient, medical, or other personal health information (including but not limited to protected health information under HIPAA);
  17. is or includes financial information, including but not limited to credit and debit card information;
  18. is or includes social security numbers or other government identifiers (for example IDs or passports);
  19. is or includes protected data about minors (such as data protected by the Children's Online Privacy Protection Act); or

4. Fair Use

Filmia's Products, including any AI-powered tools or features, are intended for personal, human use only. Each subscription or account is strictly personal and may only be used by the individual user to whom it has been assigned.

You may not share, sell, resell, sublicense or otherwise grant access to your account or any of its features to third parties. Likewise, you must not use the Products through any form of automation, bots, or external tools. Any form of mass generation, scraping, or automated generation or extraction of content or metadata, or any other technique intended to artificially increase usage, output or circumvent technical or contractual limits is strictly prohibited.

5. Monitoring

Filmia has the right, but not the obligation, to monitor or investigate your use of the Products at any time for compliance with this AUP and each Products Terms of Service, or any other agreement between you and Filmia governing your use of the Filmia's Products. Likewise, in the event we detect any breach of this AUP that is alleged to be unlawful or otherwise, Filmia may disclose such content to law enforcement or other governmental authorities, or in response to a court order. Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP, including taking no action at all, will be at our sole discretion. 6. Sanction

If you violate this policy or encourage, allow or assist others to do anything to violate this policy, we will take any action we consider necessary to protect Filmia, our users, and third parties. This may include quarantining or deleting data stored on the Services, removing any of your content, or suspending your use or access to the Services. Please note that violation of this policy may result in termination in accordance with our termination rights in our agreement with you. You will not be entitled to any credit or other compensation for any interruption of the Services caused by your violation of this policy.

We may, at any time and without notice, remove any content and/or materials, and suspend or terminate your account or your access to the Service if you engage in activities that violate this AUP, including activities outside of your use of the Service.
